Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of HostAtlas, an infrastructure monitoring and management platform operated by Akyros Labs LLC ("Company", "we", "us", "our"), a limited liability company registered in Sheridan, Wyoming, United States of America.

By creating an account on HostAtlas, accessing the platform at hostatlas.app, installing the HostAtlas agent, or otherwise using any part of our services, you agree to be bound by these Terms in their entirety. If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not create an account or use our services. Your continued use of HostAtlas constitutes ongoing acceptance of these Terms.

These Terms should be read in conjunction with our Privacy Policy, which explains how we collect, use, and protect your data.

2. Description of Service

HostAtlas is an infrastructure monitoring and management platform that provides the following capabilities:

  • Agent-based server monitoring — a lightweight Go agent installed on your servers that automatically discovers services, domains, containers, and SSL certificates, and reports system metrics
  • Uptime monitoring — HTTP, HTTPS, TCP, and ping checks from multiple global probe locations
  • Heartbeat monitoring — cron job and scheduled task monitoring via periodic pings
  • Incident management — automated incident creation, escalation, acknowledgment, and resolution tracking
  • Domain management — domain inventory, DNS monitoring, WHOIS tracking, and SSL certificate expiry alerts
  • AI-powered analysis — optional integration with third-party AI providers (Groq, OpenAI, Anthropic) for server diagnostics and log analysis
  • Automation recipes — configurable automation rules that trigger actions based on monitoring events
  • Reporting — scheduled and on-demand reports on infrastructure health, uptime, and incidents
  • Status pages — public-facing status pages for communicating service health to your users
  • API and webhooks — programmatic access to all platform features and real-time event notifications
  • CLI tool, SSH client, and MCP server — additional tools for managing your infrastructure from the command line

We reserve the right to modify, add, or remove features at any time. We will provide reasonable notice for changes that materially affect your use of the platform.

3. Account Registration

3.1 Account Requirements

To use HostAtlas, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information to keep it accurate
  • Maintain the security and confidentiality of your account credentials
  • Immediately notify us of any unauthorized access to your account

3.2 Account Restrictions

  • You must be at least 16 years of age to create an account
  • One account per individual or organization. Creating multiple free accounts to circumvent plan limits is prohibited
  • You are solely responsible for all activity that occurs under your account, whether or not you authorized that activity
  • We reserve the right to refuse registration or cancel accounts at our discretion

3.3 Account Security

We strongly recommend enabling two-factor authentication (2FA) on your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Plans and Billing

4.1 Subscription Plans

HostAtlas offers both free and paid subscription plans. Each plan includes specific limits on the number of servers, connections, team members, monitors, and other features. Current plan details and pricing are available on our pricing page.

4.2 Merchant of Record

All billing, payment processing, invoicing, and tax compliance are handled by Polar.sh, which acts as our Merchant of Record. This means:

  • Polar.sh is the legal seller for all paid HostAtlas plans
  • Polar.sh processes your payment, issues invoices, and handles all applicable taxes (VAT, sales tax, etc.)
  • Your payment relationship is with Polar.sh. We do not store or process payment card details
  • Polar.sh's terms of service and privacy policy apply to payment processing

4.3 Pricing Changes

We may change our pricing at any time. Price changes will be communicated to existing subscribers via email at least 30 days before they take effect. Price changes apply to the next billing cycle after the notice period.

4.4 Plan Limits

Each plan enforces limits on the number of servers, connections, team members, uptime monitors, heartbeat monitors, and other resources. If you exceed your plan's limits, you may be required to upgrade to a higher plan. We will notify you before enforcing any restrictions.

5. Cancellation and Refunds

5.1 Cancellation by You

You may cancel your paid subscription at any time through your account settings or by contacting us. When you cancel:

  • Your cancellation takes effect at the end of the current billing period
  • You retain access to paid features until the end of your billing period
  • After your billing period ends, your account reverts to the free plan
  • Your data remains accessible on the free plan, subject to free plan limits

5.2 Refund Policy

We do not provide prorated refunds for partial billing periods. If you cancel mid-cycle, you will not be charged for the next billing period, but no refund is issued for the current period. Refund requests for exceptional circumstances may be directed to hello@akyroslabs.com.

5.3 Account Deletion

You may request complete deletion of your account and all associated data at any time. Upon receiving a deletion request, all your data will be permanently removed from our systems within 30 days. Account deletion is irreversible — please export any data you wish to keep before requesting deletion.

6. Acceptable Use Policy

You agree to use HostAtlas in a lawful and responsible manner. The following activities are strictly prohibited:

6.1 Prohibited Activities

You may NOT:

  • Use HostAtlas for any illegal activities, including but not limited to unauthorized surveillance, cyberattacks, or distribution of illegal content
  • Attempt to gain unauthorized access to other users' accounts, data, or systems
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the HostAtlas platform (excluding the open-source agent)
  • Use the platform to plan, coordinate, or conduct attacks against third-party systems or networks
  • Resell, sublicense, or redistribute access to HostAtlas without prior written authorization from Akyros Labs LLC
  • Exceed reasonable API rate limits or deliberately overload our systems with excessive requests
  • Store or transmit malware, viruses, or other malicious code through the platform
  • Use automated scripts, bots, or scrapers to extract data from the platform beyond the capabilities provided by our API
  • Interfere with or disrupt the integrity or performance of the platform or its infrastructure
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Violate any applicable local, state, national, or international law or regulation

6.2 Enforcement

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this Acceptable Use Policy. Actions may include issuing warnings, suspending or terminating accounts, reporting to law enforcement, and pursuing legal remedies.

7. Your Data

7.1 Data Ownership

You retain full ownership of all data you provide to HostAtlas, including server data collected by the agent, monitoring configurations, incident records, and any other content you create on the platform. We do not claim any ownership rights over your data.

7.2 License to Process

By using HostAtlas, you grant us a limited, non-exclusive, worldwide license to process, store, and display your data solely for the purpose of providing and maintaining the HostAtlas service. This license terminates when you delete your account.

7.3 No Data Sales

We do not sell, rent, or trade your data to third parties. Your data is used exclusively to provide the service you subscribed to.

7.4 Your Responsibility

You are responsible for the data collected by the HostAtlas agent on your servers. You must ensure that you have the legal right to collect and transmit such data to our platform, particularly if your servers process data belonging to third parties.

7.5 Data Export

You may export your data at any time using the CSV export functionality available within the platform. Export is available for servers, domains, heartbeats, incidents, and other key data sets.

7.6 Data Deletion

Upon account deletion, all your data is permanently removed from our systems within 30 days. This includes all server data, monitoring configurations, incidents, reports, and any other content associated with your account.

8. Intellectual Property

8.1 Platform Ownership

The HostAtlas platform, including its user interface, design, code, documentation, APIs, and all related materials, is the exclusive property of Akyros Labs LLC. All rights not expressly granted to you under these Terms are reserved.

8.2 Open-Source Agent

The HostAtlas Agent is released under the MIT License and is available as open-source software. Your use of the agent is governed by the MIT License in addition to these Terms. In the event of a conflict between the MIT License and these Terms regarding the agent software, the MIT License prevails.

8.3 Additional Tools

The HostAtlas CLI Tool, SSH Client, MCP Server, and other companion tools may be released under separate licenses. Please refer to the individual repositories for their specific license terms.

8.4 Trademarks

"HostAtlas", the HostAtlas logo, and related branding are trademarks of Akyros Labs LLC. You may not use our trademarks without prior written permission, except as reasonably necessary to identify our service in the context of your legitimate use (for example, linking to our platform from your website).

9. Agent Software

9.1 Installation and Permission

The HostAtlas Agent is a lightweight Go binary that runs on your servers. By installing the agent, you confirm that:

  • You have the legal right and administrative access to install software on the server
  • You authorize the agent to collect system information as described in our Privacy Policy
  • You understand that the agent will communicate with the HostAtlas platform over outbound HTTPS

9.2 Agent Behavior

The HostAtlas Agent is designed with security as a priority:

  • The agent only executes whitelisted, read-only commands for system discovery and metric collection
  • The agent communicates outbound only — no inbound ports are opened on your server
  • All communication is encrypted via TLS and authenticated with per-server tokens
  • The agent consumes minimal system resources (typically under 20 MB RAM)

9.3 Removal

You may uninstall and remove the agent from your servers at any time. Removal instructions are available in our documentation. Removing the agent will stop all data collection from that server but will not delete historical data already stored on the platform.

9.4 Your Responsibility

You are responsible for keeping the agent updated to the latest version. Outdated agents may not function correctly or may lack security patches. You are also responsible for the configuration of automation recipes and any actions triggered on your servers as a result of your configuration.

10. Service Availability

10.1 Availability Commitment

We strive to maintain high availability of the HostAtlas platform and invest significantly in redundancy, monitoring, and infrastructure quality. However, we provide no guaranteed Service Level Agreement (SLA) for uptime or availability.

10.2 Maintenance

We may perform scheduled and unscheduled maintenance on the platform. We will provide reasonable advance notice for scheduled maintenance whenever possible. During maintenance windows, monitoring and alerting may be temporarily suppressed to prevent false positives.

10.3 No Liability for Downtime

WE ARE NOT LIABLE FOR ANY DOWNTIME, SERVICE INTERRUPTIONS, DATA LOSS, OR DELAYED ALERTS, WHETHER CAUSED BY HARDWARE FAILURE, SOFTWARE BUGS, NETWORK ISSUES, THIRD-PARTY SERVICE OUTAGES, MAINTENANCE, OR ANY OTHER REASON. YOU ACKNOWLEDGE THAT NO MONITORING PLATFORM CAN GUARANTEE 100% UPTIME AND THAT HOSTATLAS SHOULD NOT BE YOUR SOLE MEANS OF MONITORING CRITICAL INFRASTRUCTURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

11.1 Exclusion of Consequential Damages

IN NO EVENT SHALL AKYROS LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE HOSTATLAS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.2 Cap on Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF HOSTATLAS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US (THROUGH POLAR.SH) IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES, OUR MAXIMUM LIABILITY SHALL BE FIFTY US DOLLARS (USD $50.00).

11.3 Specific Exclusions

Without limiting the above, we are specifically not liable for:

  • Actions taken by the HostAtlas agent on your servers based on your configuration, including automation recipes and their consequences
  • Outages or errors caused by third-party services, including AI providers, DNS providers, CDN providers, or payment processors
  • Data loss resulting from your failure to maintain backups of your own infrastructure
  • Missed alerts or delayed notifications due to email delivery issues, misconfiguration, or platform outages
  • Security breaches resulting from your failure to maintain account security (e.g., weak passwords, shared credentials, disabled 2FA)

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Akyros Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of HostAtlas in violation of these Terms or any applicable law
  • Data you process, store, or transmit through the HostAtlas platform, including data collected by agents installed on servers you manage
  • Actions performed by the HostAtlas agent on your servers based on your configuration, including automation recipes
  • Your violation of any third party's rights, including privacy rights and intellectual property rights
  • Any dispute between you and a third party relating to your use of HostAtlas

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last updated" date at the top of this page
  • Material changes will be communicated via email to all registered users at least 30 days before they take effect
  • We may also display a notice within the HostAtlas platform to inform you of significant changes

Your continued use of HostAtlas after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the platform and may cancel your account before the changes take effect.

14. Termination

14.1 Termination by Us for Cause

We may immediately suspend or terminate your account without notice if you:

  • Violate these Terms or the Acceptable Use Policy
  • Engage in fraudulent, abusive, or illegal activity
  • Fail to pay applicable fees
  • Pose a security risk to the platform or other users

14.2 Termination by Us Without Cause

We may terminate your account for any reason by providing at least 30 days written notice via email. In such cases, we will provide a prorated refund for any prepaid, unused subscription period.

14.3 Effect of Termination

Upon termination:

  • Your right to access and use HostAtlas ceases immediately (or at the end of the notice period, as applicable)
  • You may request a data export within 30 days of termination
  • After 30 days, all your data will be permanently deleted from our systems
  • Agents installed on your servers will stop functioning but will not be automatically uninstalled — you are responsible for removing them

14.4 Survival

The following sections survive termination of these Terms: Intellectual Property (Section 8), Limitation of Liability (Section 11), Indemnification (Section 12), Governing Law (Section 15), and any other provisions that by their nature should survive.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming. You irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue or jurisdiction.

15.3 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at hello@akyroslabs.com. We will attempt to resolve the dispute informally within 30 days. If the dispute is not resolved within that period, either party may proceed with formal legal action.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Akyros Labs LLC regarding your use of HostAtlas. These Terms supersede all prior or contemporaneous agreements, proposals, representations, warranties, and understandings, whether oral or written, regarding the subject matter herein.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

No oral or written statement by any representative of Akyros Labs LLC, other than what is contained in these Terms, shall be binding.
